By accessing or using the Website, submitting a form, or engaging our services, you acknowledge and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not access or use the Website or services.

 

1. Eligibility

To use the Website or engage our services, you must be at least 18 years of age and capable of entering a binding legal agreement. If you are under 18, you must obtain the consent of a parent or guardian.

For notarization services, all signers must meet identification and competency requirements under Florida notary law. We reserve the right to decline service if we cannot verify identity, competency, or willingness to sign in accordance with applicable laws.

Wilkerson Notary Services, LLC provides notary services in the State of Florida, which may include:

  • Mobile Notary services

  • Remote Online Notarization (RON)

  • Mobile Ink Fingerprinting

  • Wedding Services

  • Apostille services, including Florida Department of State filings

  • Document preparation support related to notarization

  • Appointment scheduling, confirmations, and follow-up communications

 

Use of the Website does not guarantee appointment availability or service acceptance. We reserve the right to decline any service request at our sole discretion, including in cases where required identification cannot be verified, the document or signing party does not meet legal requirements, or the requested service falls outside our jurisdiction or capability.

 

3. Communication Consent (SMS and Email: A2P and TCPA Compliance)

By submitting your contact information through our Website or service forms, you consent to receive communications from Wilkerson Notary Services, LLC via email and SMS.

SMS messages may include transactional (non-marketing) messages such as:

  • Appointment confirmations

  • Appointment reminders (24 hours and 1 hour before scheduled service)

  • Cancellation, rescheduling, and scheduling notifications

  • Apostille status updates (such as documents received, submitted to the Florida Department of State, returned, and ready for pickup or delivery)

  • Missed call follow-up messages

  • Payment confirmations and invoice reminders

  • Post-service review requests

Promotional (marketing) SMS messages may include announcements of seasonal offers, service updates, or renewal reminders. Promotional messages will only be sent if you have separately and explicitly opted in to receive marketing communications.

Message frequency varies depending on the services you have requested and your engagement with our communications.

 

Message and data rates may apply for any messages sent to or from you.

Consent to receive SMS messages is not a condition of purchase or service.

You may opt out at any time by replying STOP. After you send the SMS message STOP, you will receive a confirmation message confirming that you have been unsubscribed. You will no longer receive SMS messages unless you opt in again.

End users provide consent to receive SMS messages by voluntarily submitting their contact information through our Website forms and affirmatively checking a clearly displayed, unchecked consent checkbox at the time of submission.

 

4. Carrier Liability Disclaimer

Wireless carriers are not responsible or liable for delayed or undelivered messages. SMS delivery is not guaranteed and depends on your mobile provider's performance.

 

5. Booking and Service Requests

Certain services may require an online booking, intake form submission, or deposit.

 

You agree to:

  • Provide accurate, current, and complete information

  • Maintain the confidentiality of your contact information

  • Be responsible for all communications and submissions made through your device or account

  • Provide valid government-issued identification at the time of notarization

  • Comply with any technical or environmental requirements for Remote Online Notarization sessions, including a working camera, microphone, and stable internet connection

 

6. User Conduct

 

You agree not to:

  • Use the Website for unlawful purposes

  • Submit false, fraudulent, or misleading information

  • Misrepresent your identity or that of any signer in connection with a notarization

  • Interfere with the functionality or security of the Website

  • Attempt to access restricted areas or data without authorization

  • Use automated scripts or bots to access or submit forms

 

We reserve the right to restrict, suspend, or terminate access if misuse, fraudulent activity, or violation of these Terms is detected.

 

7. Payments, Deposits, and Refunds

 

All paid notary services are processed in accordance with the pricing presented at the time of booking, by invoice, or as otherwise communicated.

 

Specific payment terms include:

  • Mobile Notary services require a non-refundable deposit at the time of booking

  • Remote Online Notarization (RON) requires payment in advance of the scheduled session

  • Apostille services may require an upfront deposit and processing fee

  • All remaining balances are billed by invoice upon service completion

 

Refunds will only be issued in the event of an error attributable to Wilkerson Notary Services, LLC. Deposits and prepayments are non-refundable in the following circumstances:

  • The client cancels with less than the required notice

  • The client fails to appear at a scheduled appointment (no-show)

  • The notary has already departed for a mobile appointment when cancellation occurs

  • Identity verification fails during a Remote Online Notarization session and the session cannot be completed

  • The client provides incorrect or incomplete information that prevents the service from being delivered

 

Cancellation and reschedule requests must be received at least two (2) hours prior to the scheduled appointment time. Last-minute cancellations or no-shows require a new booking and a new deposit before service can be rescheduled.

You authorize our payment processor to charge the payment method you provide for any agreed-upon services.

 

8. Intellectual Property

All content on this Website, including text, graphics, branding, logos, videos, design elements, and layouts, is the property of Wilkerson Notary Services, LLC or its licensors and is protected under U.S. intellectual property laws.

You may not reproduce, republish, copy, sell, or exploit any part of the Website or its content without prior written permission.

 

9. Third-Party Links and Services

Our Website may include links to third-party websites or use third-party services (such as payment processors, scheduling platforms, document delivery services, and Florida Department of State filing services). We are not responsible for the content, services, or privacy practices of third parties. You access these third-party services at your own risk.

11. Notary Compliance

All notarial acts performed by Wilkerson Notary Services, LLC are conducted in accordance with applicable Florida law, including Florida Statutes Chapter 117. Notarizations cannot be performed in the following circumstances:

  • The signer is unable to verify their identity through legally accepted means

  • The signer is not present (in person or via approved RON platform) at the time of notarization

  • The signer appears to be under duress, incapacitated, or unable to understand the document

  • The notary has a personal interest in the document

  • The document is incomplete, fraudulent, or otherwise improper

 

Wilkerson Notary Services, LLC reserves the right to decline any notarization that does not comply with applicable law or professional standards.

 

12. Termination

We may suspend or terminate your access to the Website and communications at any time and without prior notice if:

  • You violate these Terms

  • We suspect misuse, fraudulent activity, or unlawful conduct

  • We cease offering services through the Website

 

Upon termination, your rights to access or use the Website and services will immediately cease.

 

13. Limitation of Liability

To the fullest extent permitted by law, Wilkerson Notary Services, LLC is not liable for any indirect, incidental, special, or consequential damages, including but not limited to lost profits, data loss, missed deadlines, or service interruption arising from or related to:

  • Use or inability to use the Website or services

  • Reliance on content or information displayed

  • Delays caused by third-party services, including the Florida Department of State, courier and delivery providers, or payment processors

  • Any conduct or content of third parties

 

All Website content is provided "as is" without warranties of any kind. Our total liability for any claim related to a specific service shall not exceed the amount paid for that service.
